Petitioner has filed this petition under Section 439 Cr.P.C. for grant of regular bail in case FIR No.75 dated 14.07.2015 under Section 22 of the NDPS Act, registered at Police Station GRP Amritsar. Notice of motion was issued. Learned State counsel appeared and contested the petition.

I have heard learned counsel for the petitioner as well as learned State counsel and have gone through the record. From the record, I find that the recovery from the present petitioner as per FIR is 155 grams of intoxicant powder. Earlier, the petitioner was granted interim bail. Now, as per report of the FSL, the contraband found to be containing diphenoxylate salt and recovery falls in Vineet Gulati 2017.05.26 16:11 I attest to the accuracy and authenticity of this document Chandigarh

CRM No.M-39831 of 2016 -2commercial quantity. The interim granted to the petitioner was cancelled and he was taken in judicial custody.

Keeping in view the provisions of Section 37 of the NDPS Act, the bail is not to be granted in the case of commercial quantity. Therefore, finding no merit in the present petition, the same is dismissed.
