This is a civil writ petition filed under Articles 226/227 of the Constitution of India for issuance of a writ in the nature of mandamus directing the respondents to grant an effective opportunity to the petitioner to submit the second year fee which is outstanding for the course of Masters of Physical Education for the Session 2023.

Learned counsel for the petitioner has submitted that the petitioner is a student of second year in Guru Nanak Dev University, Amritsar and is studying in the course of Master of Physical Education, in the Department of Physical Education. It is submitted that the petitioner was not able to deposit the fee for the second year on account of financial difficulty and the last date regarding the same has elapsed and the petitioner is now ready and willing to deposit the total outstanding fee, along with late fee charges of Rs.5,000/-, within a period of three days from today. It is submitted that in case the said fee is not accepted by the respondentauthority, then the future of the present petitioner would be in jeopardy. 3.

CWP-9001-2023 -22023:PHHC:060751 that the last date for submission of fee along with late fee charges has already elapsed and the authority does not have the power to condone any delay, thus, the application of the petitioner was not accepted. 4.

This Court has heard learned counsel for the parties and has perused the paper book.

The petitioner is a student of Guru Nanak Dev University, Amritsar and is studying in second year in the course of Master of Physical Education, in the Department of Physical Education and has passed the first year. It is the case of the petitioner that he could not pay the outstanding fee for the second year on account of financial difficulty and has stated that he is ready and willing to pay the outstanding fee for the second year, along with late fee charges of Rs.5,000/-, within a period of three days from today. In case, the fee is not accepted by the respondent-University, then the future of the petitioner would be in jeopardy. 6.

Thus, keeping in view the above said exceptional facts and circumstances, the present writ petition is allowed with the following directions:- (i) The petitioner would approach the respondent-University within a period of three days from today and offer the outstanding fee for the second year, along with late fee charges of Rs.5,000/-.

(ii) In case, the petitioner approaches the respondentUniversity within a period of three days from today with the outstanding fee of second year along with the penalty/late charges of Rs.5,000/-, the same shall be accepted by the respondent-University.
