Mr. Shiva Khurmi, Assistant Advocate General, Punjab. MANJARI NEHRU KAUL, J. (ORAL) Case has been called twice, however, even on second call, there is no representation on behalf of the petitioner. 2.

The instant petitions were filed way back on 24.04.2023 and 03.07.2023 for issuance of directions to protect the life and liberty of petitioner and his brother and family members, who were allegedly being harassed by the official respondents and were being threatened with false implication in criminal cases.

Learned State counsel has at the outset drawn the attention of this Court to the status report dated 25.05.2023 filed by way of affidavit of Superintendent, Central Jail, Ludhiana. It has been submitted that the petitioner is in fact a man of criminal antecedents as is evident from paragraph 2 of the status report, wherein the details of the other criminal cases, which stand registered against him, have been

Further attention of this Court has been drawn to paragraph 3 of the status report, wherein it stands reflected that the brother of the petitioner namely Akash Chopra alias Honey is also involved in as many as as four criminal cases including cases under the NDPS Act. Furthermore, learned State counsel has submitted that in fact, there had been a quarrel between the jail inmates including the brother of the petitioner; the Deputy Superintendent (Security), Central Jail, Ludhiana, had, therefore, recommended that both, brother of the petitioner and the other inmate be lodged separately and a recommendation had also been made for stoppage of their 'mulakat' facility for one month along with stoppage of canteen/PICS facilities for another 15 days as per Rules.

It was in the aforementioned circumstances that the petitioner was trying to level false allegations of harassment against the official respondents by concocting a fabricated story that some extraneous demands were being made from them by the official respondents. Learned State counsel has also drawn the attention of this Court to paragraph 8 of the aforementioned status report, wherein it has been detailed that following a false complaint made, a DDR No.25 dated 19.04.2023 was registered against the brother of the petitioner.

Short reply by way of affidavit of Deputy Superintendent of Police, Special Task Force, Ludhiana Range, Ludhiana, in CRM-M-6917-2023 has also been filed in Court, which is taken on record.

Despite the case having been called twice, none has entered appearance on behalf of the petitioner. It appears that the petitioner is not interested in pursuing the matters any further.
