State of Punjab & others ... Respondents CORAM: HON'BLE MRS. JUSTICE MANJARI NEHRU KAUL

Present:

Mr. D.S. Gandhi, Advocate for the petitioners. MANJARI NEHRU KAUL, J. (ORAL) The instant petition has been filed under Article 226/227 of the Constitution of India for issuance of writ in the nature of mandamus seeking directions to the official respondents to protect the life and liberty of the petitioners at the hands of private respondents. Learned counsel submits that instead of an FIR No.0170 under Sections 302, 148, 149 IPC having been registered against the private respondents way back on 11.08.2022 at Police Station Lopoke, District Amritsar Rural, no action has been taken against them and rather they are threatening the petitioners with dire consequences and pressurizing them to withdraw the complaint. It has been further submitted that representation (Annexure P-6) dated 11.04.2023 was also made to respondent No.5 - Senior Superintendent of Police, District Amritsar, however, it had proved to be in vain. Notice of motion to the official respondents.

2023:PHHC:060831 CRWP No.4115 of 2023 At the asking of Court, Mr. Amit Rana, Sr. Deputy Advocate General, Punjab accepts notice on behalf of the said respondents.

In view of the submissions made by learned counsel for the petitioners, the petition is disposed of with a direction to respondent No.5 - Senior Superintendent of Police, District Amritsar to look into the representation (Annexure P-6) dated 11.04.2023 and take necessary steps, if any required, in accordance with law.
