******* SURINDER GUPTA, J.(Oral) Present petition has been filed under Section 438 Code of Criminal Procedure for grant of anticipatory bail to the petitioner in case FIR No. 90 dated 12.05.2016 registered for offences punishable under Sections 420, 465, 468, 471 of Indian Penal Code (for short 'IPC'), at Police Station City Phagwara, District Kapurthala.

Heard.

Allegations against the petitioner are that she before her marriage with the complainant in the year 2012 had got prepared a voter card and ration card in the year 2008 showing herself to be the wife of complainant. Using those documents she later on got prepared passport in the year 2012.

Learned counsel for the complainant submits that the petitioner has married four times and her marriage with the complainant was her fourth marriage.

CRM-M-39897 of 2016 -2Learned State counsel submits that above facts have come to notice when matrimonial relations between the complainant and petitioner became strained.

After giving a careful thought to submissions of learned counsel for the petitioner, learned State counsel and learned counsel for the complainant, I find it to be a fit case to extend the benefit of anticipatory bail to the petitioner for the reason that allegations against the petitioner are based on documentary evidence and to verify documents her custodial interrogation is not required.

Without expressing any opinion on the merits of the case, this petition is allowed and order dated 10.11.2016 is made absolute till the presentation of challan, subject to the following terms:- (i) that the petitioner shall make herelf available for interrogation by the police as and when required; (ii) that the petitioner shall not, directly or indirectly, make any inducement, threat or promise to any person acquainted with the facts of the accusation against her so as to dissuade him from disclosing such facts to the Court or to any police officer;

(iii) that the petitioner shall not leave India without the prior permission of the Court.

(iv) that the petitioner will seek regular bail on the presentation of challan in Court.
