It transpires that FIR for the aforesaid offences was lodged against the petitioner by the complainant Dilbar Singh resulting into filing of cancellation report after investigation. Upon a protest petition, learned Magistrate has proceeded to treat the allegations as complaint case. The issue of summoning is concededly pending.

After arguing for sometime and realising that the present petition is misconceived and premature,learned counsel prays for permission to withdraw the same.
