Learned counsel appearing for the respondent submits that the appellant-Board had voluntarily made the payment in the execution proceedings, a small portion thereof however remains, which is also under consideration.

Learned counsel for the appellant-Board is unable to dispute the aforesaid fact and submits that the present appeal may be disposed of as having been rendered infructuous.
