The petitioner assails order dated 10.4.2024 passed by learned Additional Sessions Judge, Kaithal (Annexure P-4) vide which learned Lower Appellate Court has directed the petitioner to deposit an amount equal to 20% of compensation amount as awarded by the Trial Court. 2.

Learned counsel for the petitioner submitted that although the petitioner has already deposited 20% of the cheque amount, which works out to Rs.37,620/- but there is a deficit of about Rs.18,810/- in case 20% of the compensation amount is to be deposited. It has been informed that the appeal is now fixed for arguments before the Lower Appellate Court on 13.8.2024. 3.

Having heard learned counsel for the petitioner, the instant petition is disposed of with a direction to the petitioner to ensure that the appeal, which is pending before learned Lower Appellate Court, is argued on 13.8.2024 Pankaj Kakkar 2024.07.16 17:02 I attest to the accuracy and authenticity of this document

CRM-M-20980-2024 (O&M) ( 2 ) unless the Court itself chooses to adjourn the matter for some justifiable reason. The Lower Appellate Court shall not insist upon deposit of the aforesaid balance amount of Rs.18,810/- till the next date of hearing before the Lower Appellate Court i.e. till 13.8.2024. 4.

In case, the petitioner does not argue the appeal on the next date, the aforesaid interim directions shall automatically stand vacated. 5.

A copy of this order be conveyed to Appellate Court before which the appeal is pending.
