***** Rajan Gupta, J. (Oral) This petition has been filed under Section 439 Cr.P.C. seeking regular bail to the petitioner in a case FIR No.198 dated 16.12.2016 under Sections 307, 326, 325, 324, 323, 341, 506, 34 and 120-B IPC at Police Station Sadar, Samana, District Patiala.
At the outset, it is contended that the evidence of four material witnesses is complete. Petitioner is incarcerated since 29.12.2016. No useful purpose would be served by detaining him any longer. Learned State counsel has opposed the prayer for bail. Keeping in view period of incarceration of the petitioner and the fact that the trial may still take some time to conclude, no useful purpose would be served by detaining the petitioner any longer. Thus, without expressing any opinion on the merits of the case, this petition is allowed. Petitioner is directed to be enlarged on bail to the satisfaction of Chief Judicial Magistrate/Duty Magistrate, Patiala.
