The petitioner along with Gurvinder Singh and Kulbir Singh had impersonated in place of Jagtar Singh and his two sons and mortgaged their land with Oriental Bank of Commerce and obtained a loan of Rs. 65 lacs.

Counsel for the petitioner submits that it is Gurjit Singh, who master minded the entire crime. It has also been submitted that Gurjit Singh has been arrested and the entire amount of Rs. 65 lacs has been returned to the bank by him and the property alleged to have been mortgaged, stands redeemed. No due certificate pertaining to the loan amount has been placed on record.

On asking of the court, ASI Joginder Singh confirms the said fact. It has been informed that the petitioner is required in another case. In view of the above circumstances, the petition is allowed. It is ordered that in case of arrest of the petitioner he will be released on bail subject to the following conditions:-

1) The petitioner will join the investigation within a period of one month.

2) He will not tamper with evidence or hamper the investigation.

In case the petitioner does not join the investigation, on notice having been issued to him, within a period of one month, this petition will be deemed to have been dismissed.
