SURINDER GUPTA, J.(Oral) Additional affidavit of petitioner no. 2-Toshif filed by learned counsel for petitioners is taken on record.
Learned counsel for petitioners submits that petitioners have filed this petition seeking protection of their life and liberty alleging that they are major and have married against the wishes of respondents No. 4 to 6, who are parents and brother of petitioner No. 1. Apprehending danger to their life and liberty, they moved representation dated 09.09.2018 (Annexure P-4) to Superintendent of Police, Faridabad. In view of the submission of learned counsel for the petitioners, but without expressing any opinion on the validity of marriage of petitioners, petition is disposed of with direction to Commissioner of Police, Faridabad to look into representation dated 09.09.2018 (Annexure P-4) addressed to respondent No.2-Superintendent of Police, Faridabad and take appropriate action in accordance with law, on receipt of copy of this order along with representation in his office.
However, it is made clear that this order will have no effect on the validity of alleged marriage of the petitioners or on any other civil or criminal proceedings instituted against them and nothing observed herein shall effect the liability of petitioner no. 2-Toshif as per provisions of The Prohibition of Child Marriage Act, 2006.
