CORAM:

HON'BLE MS. JUSTICE RITU BAHRI

Present:

Mr. Jagjit Singh, Advocate for the petitioners.

Mr. J.S. Sekhon, AAG, Punjab.

**** RITU BAHRI, J. (Oral) Present petition has been filed under Section 482 Cr.P.C. for quashing of FIR No.27 dated 07.04.2015, under Sections 363, 366-A and 34 IPC, registered at Police Station Verowal, District Tarn Taran. Present FIR has been registered on the statement of respondent No.2, alleging that on 26/27.03.2015 in midnight, her minor daughter, namely, Gurjant Kaur, who is aged about 151⁄2 years old, had been enticed by petitioner No.1 in connivance of petitioner Nos.2 and 3 on the pretext of marriage without her consent.

Learned counsel contends that petitioner No.1 has solemnized marriage with Gurjant Kaur @ Janti (daughter of respondent No.2) on 02.04.2015 without the consent of respondent No.2 and other family Naresh Kumar 2017.07.10 15:09 I attest to the accuracy and integrity of this document Chandigarh members. Due to fear, they are hiding themselves to save their lives.

CRM-M-39098-2015 -2Learned counsel further contends that since petitioner No.1 and Gurjant Kaur @ Janti were apprehending threat to their life and liberty at the hands of respondent No.2 and another, they approached this Court by way of CRM M-11210-2015 seeking protection and the same was disposed of vide order dated 08.04.2015. Moreover, a daughter was born on 02.01.2016 from the said wedlock and they are leading a happy married life. On 19.11.2015 notice of motion was issued and on that date Gurjant Kaur @ Janti (daughter of respondent No.2) was appeared in the Court and stated that she has performed marriage with petitioner No.1 of her own free will.

Keeping in view the facts that petitioner No.1 and Gurjant Kaur @ Janti are happily residing together as husband and wife and a child was also born to them on 02.01.2016, it would, therefore, be appropriate to secure the ends of justice that the criminal case is put to an end. Accordingly, the present petition is allowed and FIR No.27 dated 07.04.2015, under Sections 363, 366-A and 34 IPC, registered at Police Station Verowal, District Tarn Taran and all the subsequent proceedings arising therefrom qua petitioners are hereby quashed .
