Petitioner has filed this petition under Section 439 of the Code of Criminal Procedure, 1973 seeking regular bail in FIR No. 408 dated 15.7.2015 under Section 392, 397 of the Indian Penal Code, 1860 ('IPC' for short) and Section 412 IPC and Section 25 of the Arms Act, 1959 (added later on), registered at Police Station City Jagadhari, District Yamuna Nagar. Learned counsel for the petitioner has submitted that petitioner had allegedly purchased the car in question. Petitioner had no knowledge that the car in question was a stolen property. As per the prosecution case, Varun, co-accused of the petitioner, had made a statement that he along with Shubham Pandit and Malkeet had taken the car in question from the complainant. Thereafter the said car was sold to the petitioner. On a query put by this Court, learned State counsel who is assisted by Assistant Sub Inspector Satpal, has submitted that GURPREET SINGH 2015.11.26 16:47 I attest to the accuracy and authenticity of this document chandigarh

Crl. Misc. No. M-39108 of 2015 -2petitioner is not involved in any other criminal case. Petitioner is in custody since 26.7.2015. Challan has already been presented in the Court and conclusion of trial may take time.

Keeping in view the facts and circumstances of the present case, it would be just and expedient to order the release of the petitioner on bail.

Accordingly, without expressing any opinion on the merits of the case, this petition is allowed. Petitioner be admitted to bail subject to the satisfaction of Chief Judicial Magistrate, Yamuna Nagar at Jagadhari.
