******* SURINDER GUPTA, J.(Oral) Learned counsel for the petitioner submits that as per order passed by learned Sessions Judge, Faridabad, the property which has come in the hands of legal heirs on death of Deepak son of petitioner, is liable for payment of the compensation amount. He seeks permission to withdraw the petition with liberty to raise the appropriate plea before the Court concerned.

Dismissed as withdrawn with liberty as prayed for. Learned counsel for the petitioner further submits that petitioner is 70 years old and is not in a position to appear before the Magistrate on each and every date of hearing. As only recovery proceedings are going on, presence of petitioner is not required on each and every date, her presence shall remain exempted till it is specifically required by the Court concerned.
