(Oral) The petitioner seeks the grant of anticipatory bail under Section 438 Cr.P.C. in a case bearing FIR No.0065 dated 29.04.2022 under Sections 21(b)/61/85 of the Narcotic Drugs and Psychotropic Substances Act, 1985 (offence under Section 29 of the NDPS Act added later on vide DDR No.44 dated 29.04.2022) registered with Police Station Sadar Sri Muktsar Sahib, District Sri Muktsar Sahib. Nakodar Sadar, District Jalandhar. The learned State counsel submits that the petitioner has joined the investigation in terms of the order dated 20.05.2022 and is not required for custodial interrogation.

The accused-petitioner was granted the concession of interim anticipatory bail as the recovery, in the case, was effected from his coaccused, namely, Maha Singh, after which he (petitioner herein) joined the investigation. heroin which is a non-commercial quantity and there is no other case registered against the petitioner under the NDPS Act. In this view of the matter, interim order dated 20.05.2022 is made absolute.

However, the petitioner shall keep on joining the investigation as and when required to do so and he shall abide by the conditions as envisaged under Section 438(2) Cr.P.C.

The petition stands disposed of.
