The petitioners through instant petition under Articles 226/227 of the Constitution of India are seeking setting aside of final result dated 28.02.2019 (Annexure P-11) to the extent they were not selected. They are further seeking direction to respondent to grant them 5 additional marks under Socio-Economic Criteria. 2.

The petitioners pursuant to advertisement dated 28.05.2018 applied for the post of Constable under General Category. They are real brothers. They lost their father on 28.04.1998. They were minor at that point of time. They further lost their mother on 10.03.2013. They were entitled to additional 5 marks under Socio-Economic Criteria as per terms and conditions of the advertisement. Learned counsel for the petitioners submits that petitioners' case is squarely covered by judgment dated 01.12.2025 passed by this Court in CWP-10724-2019 titled as "Naveen Vs. State of Haryana and Anr."

Learned State counsel expressed his inability to distinguish instant case from aforesaid judgment, however, submits that marks of petitioners even after additional marks under Socio-Economic Criteria may be less than cut off, thus, respondent may be granted liberty to compare their marks with cut off.

In the wake of statement of both sides, the petition stands disposed of in terms of judgment of this Court in Naveen (supra). The respondents are hereby directed to grant additional 5 marks to petitioners and thereafter consider their merit. If they are found eligible, issue them appointment letter. The needful shall be done within 6 weeks from today. 6.
