Present petition has been filed under Section 439(2) of the Code of Criminal Procedure for cancellation of the impugned order dated 29.04.2021 (P-9) passed by the then Co-ordinate Bench in CRM-M-180922021, whereby respondent No.3 has been granted concession of anticipatory bail in Complaint Case No.33 dated 25.07.2017 under Section 3(10) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989 (for short, 'SCST Act'), read with Sections 323, 324, 452, 506, 148 read with Section 149 of the Indian Penal Code, 1860 (for short, 'IPC'), titled as 'Sarabjit Singh Vs. Narinder Singh and others' (P-6), pending before the Court of Judicial Magistrate 1st Class, Amritsar, in which respondent No.3 has been summoned to face the trial under Section 3(10) of the SCST Act and Sections 452 and 323 of the IPC, vide order dated 10.01.2020 (P-8). After arguing for some time, when this Court was not inclined to accept the prayer, learned counsel for the petitioner, on instructions, wishes to withdraw the present petition.
