**** ANITA CHAUDHRY, J(ORAL) This is the second petition filed by the petitioner seeking regular bail in FIR No. 16 dated 27.2.2016 registered at Police Station Women, Rohtak under Sections 323, 342, 313, 511, 506, 376(2)N and 34 IPC.

Counsel for the petitioner contends that the prosecutrix was a nurse in a Nursing Home where the petitioner had gone along with his wife for her treatment and the complainant knew that the petitioner was married and there was no misrepresentation.

Petitioner is in custody since 29.2.2016. 14 witnesses out of 18 witnesses have been examined. The prosecutrix has made a statement against the petitioner. The merits of the case are not to be considered and that is for the trial Court to consider at the appropriate stage. The first application was withdrawn on 30.8.2016 after the petitioner had completed his submissions and this Court was not inclined to Gurpreet Singh Bhatia 2016.11.23 16:15 I attest to the accuracy and authenticity of this document High Court Chandigarh

Crl. Misc. No. M-40059 of 2016 -2grant bail. No fresh grounds arise for bail. The allegations are serious. The trial is going at a fast pace.
