The petitioner through instant petition under Articles 226 and 227 of the Constitution of India is seeking interest on delayed payment of consideration for executing work for respondents. 2.

As per pleadings, the petitioner is a contractor. He was allotted work worth Rs. 3,82,616/-. The value of said work was enhanced to Rs. 16,30,333/-. He completed the work and claimed charges. He submitted final bill of Rs. 10.91 lakh which was though accepted but not released by department. He filed CWP No.21799 of 2022 before this Court which was disposed of vide order dated 21.09.2022 with a direction to respondents to pass a speaking order. The respondents did not comply with said order, thus contempt petition was filed which was finally disposed of as infructuous PARAMJIT KAUR SAINI 2026.04.23 05:39 I attest to the accuracy and integrity of this document

CWP No.9981-2025(O&M) -2becaused respondents passed order. The petitioner received Rs. 12.50 Lakh after the aforesaid litigation. He is now claiming interest. 3.

Learned counsel for the petitioner submits that there was delay on the part of respondents, thus, petitioner is entitled to interest. 4.

Learned State counsel, during the course of hearing produced copy of order dated 23.07.2025 passed by Executive Engineer (PHE) whereby petitioner's claim has been rejected. The same is taken on record. Registry is directed to tag the same at an appropriate place. 5.

The petitioner carried out construction work for respondents. It was purely a contract between two parties. As government was one of the contracting party, writ petition was entertained with respect to non-payment of admitted liability. The respondents are not admitting its liability qua interest. The claimed interest is not statutory in nature, thus, this Court cannot ask respondents to pay interest. The petitioner may avail remedies as per contract executed between the parties and other applicable provisions. 6.

In the backdrop, the petition stands disposed of. 7.
