This is a petition filed under Section 439 Cr.P.C. seeking regular bail in a case in which petitioner has been summoned to face trial under section 319 Cr.P.C.

At the outset, learned State counsel, on instructions from ASI Kewal Krishan, who is present in court, submits that petitioner has not been taken in custody in the instant case. In view of statement made by learned State counsel, learned counsel for the petitioner submits that he may be allowed to withdraw this petition with liberty to file afresh in case any cause of action survives.
