Petitioner has filed this third petition under Section 439 Cr.P.C. for grant of regular bail in case FIR No.624 dated 29.08.2016 under Sections 148, 149, 302, 120 IPC and Sections 25 and 29 of the Arms Act, registered at Police Station City, Hansi, District Hisar. Notice of motion was issued. Learned State counsel as well as learned counsel for the complainant appeared and contested the petition. I have heard learned counsel for the parties as well as learned State counsel and have gone through the record. CRM No.M-40192 of 2018 -2recovered by the present petitioner as per disclosure statement suffered by him. The complainant has not been examined in this case, so far. The case is at preliminary stage. If the bail is granted to the petitioner, then there is every chance of tampering with the evidence.
Keeping in view the above facts and circumstances of the present case, I do not find it a fit case where petitioner is entitled to benefit of regular bail.
Therefore, finding no merit in the present petition, the same is dismissed.
However, as the petitioner is stated to have been in custody since 26.08.2016, therefore, learned trial Court is directed to expedite the trial by giving short adjournments and if required, even day to day adjournments. The Investigating Officer and SHO concerned are directed to produce the witnesses before the trial Court at the earliest preferably on next 2-3 dates.
