C RM-M-18550-2026 The prayer in the present petition under Section 483 BNSS, 2023 is for the grant of regular bail in case bearing FIR No.367 dated 16.11.2025 registered under Sections 316(2), 318(4), 338, 336(3), 340(1), 340(2), 344, 61(2), 3(5) BNS, 2023 (Sections 406, 420, 467, 468, 470, 471, 477A, 120B and 34 IPC) and Section 7, 12, 13(2) of Prevention of Corruption Act, at Police Station Butana, Karnal, District Karnal. 2.

As per the allegations, the petitioner, who is the Inspector, DFSC, Indri facilitated defalcation of paddy worth Rs.2.61 crore.

CRM-M-18550-2026 (O&M) -23. The learned counsel for the petitioner contends that the petitioner has been falsely implicated in the present case. The entire defalcated amount of Rs.2.61 crores stands deposited by M/s United Foods, Indri on 05.12.2025. As such, the entire loss has been made good. As the petitioner is in custody since 06.02.2026 but none of the 23 prosecution witnesses has been examined so far, the trial of the present case is not likely to be concluded anytime soon and therefore, he is entitled to the concession of bail particularly when a co-accused namely Jasbir Singh has been granted the concession of interim anticipatory bail vide order dated 01.05.2026. 3.

The learned State counsel has not disputed the factual position that the entire defalcated amount of Rs.2.61 crores has been deposited by the miller as also the fact that the petitioner is in custody since 06.02.2026, that none of the 23 prosecution witnesses has been examined so far and that a coaccused namely Jasbir Singh has been granted the concession of interim anticipatory bail.

I have heard the learned counsel for the parties. 5.

The veracity of the prosecution case against the petitioner and his co-accused shall be adjudicated upon during the course of the Trial. Admittedly, the petitioner is in custody since 06.02.2026 but none of the 23 prosecution witnesses has been examined so far. Therefore, the Trial of the present case is not likely to be concluded anytime soon. In this situation the further incarceration of the petitioner is not required.

CRM-M-18550-2026 (O&M) -36. Thus without commenting on the merits of the case, the present petition is allowed and petitioner-Randhir Singh S/o Sita Ram is ordered to be released on bail subject to his furnishing bail bonds and surety bonds to the satisfaction of learned CJM/Duty Magistrate, concerned. 7.

The petition stands disposed of.
