NIRMALJIT KAUR, J. (ORAL) The present appeal was filed on two grounds, firstly that the driver did not have the valid licence. However, the said ground does not survive any more in view of the report having been received after the matter was remanded back that the licence was a valid licence. The second argument raised by learned counsel for the appellant-Insurance Company is that the vehicle was being used as commercial, whereas it was for private use. However, a perusal of the order of the Tribunal shows that the said ground was not pressed.

In view of the same, the appeal is dismissed being devoid of merit.
