Coram:

Hon'ble Mr. Justice Inderjit Singh .....

Present:

Mr. Rishu Mahajan, Advocate for the petitioners. .....

Inderjit Singh, J.

This criminal miscellaneous petition has been filed by the petitioners under Section 482 Cr.P.C. for directing the respondents No.2 and 3 to ensure the life and liberty of the petitioners from the hands of respondents No.4 to 7 and to look into the representation (Annexure-P.7) filed by the petitioners.

I have heard learned counsel for the petitioners and have gone through the record.

From the record, I find that in the present case, representation has been filed by Jaspal Singh one of the petitioners to the Commissioner of Police, Amritsar, in which the subject has been mentioned as regarding false applications moved by Smt. Manjit Kaur wife of Shri Dalbir Singh and taking action on these under Section 182 IPC. In the prayer clause of this Harpal Singh Parmar 2017.02.06 16:42 I attest to the accuracy and authenticity of this document Chandigarh

Cr. Misc. No.M-40222 of 2016 [2] representation also, it has been stated that Manjit Kaur has put up false allegations against him and legal action be taken under Section 182 I.P.C. Nothing has been mentioned as to how the petitioners are feeling the threat to their life and liberty. A perusal of the record shows that there is no serious threat to the life and liberty of the petitioners. Rather, in the representation, it has been mentioned that Manjit Kaur and Balwinder Kaur entered his house on 2.3.2016 at around 2.00 p.m. Manjit Kaur is mother of Jaspal Singh-petitioner/applicant. They abused his wife and had scuffle with her. It has also been mentioned in the representation that thereafter Manjit Kaur begged pardon with folded hands and agreed to an agreement in the presence of the prominent persons, which means that the matter has already been settled.

A perusal of the record shows that there is no serious threat to life and liberty of the petitioners. Rather, it looks like a family dispute qua the house etc. Civil litigation is also pending adjudication between the parties.

Therefore, from the above, I find no merit in the present petition and the same is dismissed.

February 1, 2017.
