bearing FIR No.83 dated 28.05.2020, registered at Police Station Nighdu, District Karnal, under Sections 406, 420 and 370 (added later on) IPC and Section 24 of the Immigration Act, 1983.
Learned counsel for the petitioner contends that the petitioner, who is a travel agent, has not committed any offence, and that moreover matter has been compromised with respondent No.2-complainant and an amount of Rs.10 lakh has been paid to him(respondent No.2-complainant). On the other hand, learned State counsel while opposing the prayer made in the present petition, submits that he has no instructions qua PARVEEN KUMAR 2020.08.07 04:35 I attest to the accuracy and integrity of this document
-2CRM-M-19734-2020 the compromise between the petitioner and complainant. However, learned counsel for respondent No.2-complainant does not dispute the factum of compromise with the petitioner and states that the complainant has already received an amount of Rs.10 lakh from the petitioner.
I have heard the learned counsel for the parties. It is a case in which the complainant was taken to California (USA) from where the immigration authorities deported him back to India. Now the compromise has been effected between the petitioner and complainant.
The petitioner has been in custody since 23.06.2020. Trial of the case would take time to conclude. Therefore, no useful purpose would be served by keeping the petitioner behind the bars.
