This petition seeking for direction has been filed for registration of FIR on the ground that the accused namely Mukesh Yadav, who is a builder and to whom the loan was advanced is not responding to the call of the petitioner for negotiation.

The record reveals that with regard to same allegation a complaint COMI-505-2020 was filed by the petitioner before the Court of learned Judicial Magistrate 1st Class, Gurugram and the learned Judicial Magistrate 1st Class, Gurugram vide order dated 20.02.2026 dismissed the application of the petitioner under Section 156(3) of Cr.P.C.
