Mr. Sushil Sheoran, Advocate for the petitioner(s) SANDEEP MOUDGIL, J (ORAL) The jurisdiction of this Court has been invoked under Articles 226/227 of the Constitution of India for directions to the respondents to grant compassionate appointment to the petitioner on account of the untimely death of her husband, who died while in service, leaving behind the petitioner and a minor daughter aged about 8 months.

It has been informed to the Court by the learned State counsel that on ₹ 05.08.2025, an amount of 3,00,000/- was credited as financial assistance, which was duly accepted by the petitioner, who is the wife of the deceased employee. This occurred much prior to the filing of the present writ petition. However, this material fact has been deliberately concealed, as the counsel for the petitioner argued that such financial assistance was never accepted and placed reliance on a communication dated 03.02.2026 issued by the Executive Engineer, Horticulture Division, PWD B & R.

CWP-9841-2026 -2It is apparent on the face of the record that the petitioner has made a deliberate attempt to derive undue advantage from the letter dated 03.02.2026 (Annexure P-3) while seeking compassionate appointment under Clause 12 of the Deployment of Contractual Persons Policy, 2022 as amended on 13.05.2025 (Annexure P-5), despite having already accepted the financial assistance in lieu of the said relief nearly 11 months prior to filing the present petition. In light of the above, the present petition, being devoid of merit and involving concealment of material facts with the intent to mislead the Court, stands dismissed.

However, considering the financial condition of the petitioner, this Court refrains from imposing any order as to costs. Ordered accordingly.
