Petitioner prays for anticipatory bail in FIR No.195 dated 21.10.2014, under Section 61 of the Excise Act, registered at Police Station Gate Hakima, Amritsar City.

It is contended that petitioner was not apprehended at the spot. There was no occasion for ASI Balwinder Singh to have identified him. No recovery is also to be effected from him. CRM No.M-39518 of 2014 [2] Learned counsel for the State, on instructions from ASI Balwinder Singh, submits that the petitioner has indeed joined investigation and he is no longer required for custodial interrogation. No recovery has to be effected from the petitioner.

There are no allegations on behalf of the State that petitioner is likely to abscond or that he is likely to dissuade the witnesses from deposing true facts in the Court, if released on bail. In view of the above but without commenting or expressing any opinion on the merits of the case, order dated 28.11.2014 is made absolute. Petition is allowed.
