Learned counsel for petitioner argued that petitioner is behind the bars since 14.06.2024. The trial is pending and the statements of prosecution witnesses are being recorded. He is young boy of 18 years of age. Trial may take long time. He is ready to abide by the terms of bail order. Therefore, his regular bail petition may be allowed. 4.
Bail petition is opposed by learned counsel representing State of Haryana. Detailed status report has been filed. It is confirmed that challan in this case was prepared on 26.07.2024 and the charges were framed vide order dated 17.09.2024. There are specific serious allegations. Statement of victim was recorded under Section 183 of BNSS (Annexure R-1). The statement of victim recorded under Section 161 Cr.P.C. and statement recorded with Legal Aid Counsel are Annexure R-3 and R-4. Copy of MLR is Annexure R-5. Present petitioner is involved in four other FIRs. The report of Regional Forensic Science Laboratory, Haryana is Annexure R-9 and the statement of victim recorded in the court as PW-2 is Annexure R-10. Considering the gravity of offence and specific allegations, petitioner is not entitled to be released on bail. 5.
I have considered the arguments and have gone through the record. At present petitioner is behind the bars for more than one year.
* Trial in this case is going on. The testimony of victim has been recorded as PW-2 who is also about 17 years of age. Till date only one witness has been examined. Trial in this case may take long time. The evidence and the documents proved on record will be appreciated by learned trial Court at appropriate stage. Therefore, without expressing my mind on merits of the case, + ), )
