RAMENDRA JAIN, J. (ORAL) Learned counsel for complainant-Baljit Kaur, has filed power of attorney on his own, though she has not been impleaded as party. The same is taken on record. Office to tag the same at the appropriate place. On instructions from ASI Surjit Singh, learned State counsel submits that in the impugned FIR No. 25 dated 02.04.2017, under Sections 304 and 201 read with Section 34 IPC at Police Station Sekhwan, Police District Batala, District Gurdaspur, offence under Section 302 IPC has been added yesterday, therefore, the instant petition for grant of regular bail under Sections 304 and 201 read with Section 34 IPC is meaningless. In view of the above, learned counsel for the petitioner submits that he may be permitted to withdraw the instant petition, with liberty to file afresh under newly added Section 302 IPC.

Ordered accordingly.
