HARPREET SINGH BRAR J. (Oral) Prayer in this criminal writ petition filed under Article 226 of the Constitution of India is for issuance of a writ in the nature of Habeas Corpus directing the official respondents to set free the detenue, namely Rozy, daughter of the petitioner, from the illegal detention of respondents No.4 to 6.
On 02.04.2025, the following order was passed by this Court:- "XX XX XX XX Learned counsel for the petitioner, inter alia, contends that the petitioner is mother of the detenue, namely Rozy, whose date of birth is 01.03.1996, as discernible from her Aadhar Card (Annexure P-1). On 25.03.2025, the detenue was taken away by the private respondents with bad intention and thereafter, she has been kept confined illegally by respondent No.4 and in this regard, report has been made by the petitioner to the police MOHD YAKUB 2025.04.07 18:45 I attest to the accuracy and authenticity of this document Punjab & Haryana High Court at Chandigarh
CRWP No.3339 of 2025 on 25.03.2025 itself and submitted a written representation and till date, no action has been taken thereon. Notice of motion to respondents No.1 to 3 only at this stage.
On asking of the Court, Mr. Rishabh Singla, AAG Punjab accepts notice on behalf of respondents No.1 to 3State. Learned counsel for the petitioner is directed to supply complete set of paperbook to him during course of the day.
Adjourned to 07.04.2025.
Meanwhile, learned State counsel is directed to file status report in this regard.
Learned counsel for the State, at the very outset, on instructions from ASI Bakshish Singh, submits that the daughter of the petitioner is major as she is 29 years of age and she has performed marriage with respondent No.4 with her own sweet will and as such, the allegations levelled by the petitioner are false. In view of the specific stand taken by learned State counsel, no further directions are required to be passed. Disposed of accordingly.
