*** LISA GILL, J. (ORAL) This order shall dispose of CRM-M-40377-2016 and CRM-M44292-2016. Prayer in these petitions is for grant of anticipatory bail to the petitioners in FIR No. 527 dated 22.10.2016 registered under Sections 323, 354, 448, 452, 506, 509, 34 IPC at Police Station Manesar, District Gurgaon.

Learned counsel for the petitioners submits that the dispute between the parties is purely of civil nature. The above said FIR has been filed as a counter blast to the civil suit preferred by the petitioner-Samay Singh. Both the petitioners have been falsely implicated. CRM-M-40377-2016 & CRM-M-44292-2016 -2they have joined investigation pursuant to the order dated 11.11.2016 passed by this Court. They undertake to fully cooperate with the Investigating Agency and not misuse the concession of anticipatory bail if granted to them. Therefore, these petitions be allowed. Learned counsel for the State, on instructions from ASI Suman, Police Station Manesar, Gurgaon affirms that the petitioners have joined investigation and their custodial interrogation is not required in this case. There are no allegations on behalf of the State that the petitioners are likely to abscond or that they are likely to dissuade the witnesses from deposing true facts in the Court, if released on bail. Keeping in view the facts and circumstances noted above but without expressing any opinion on the merits of case, it is considered just and expedient to allow both these petitions.
