Prayer in this petition, filed under Section 439, Cr.P.C., is for grant of bail to the petitioner, Ramesh Parjapati, son of Ram Subhag, resident of Maheshpur, Police Station, Rudrapur, District
Deveria (U.P.), who has been booked for having committed the offences punishable under Sections 420, 467, 468 and 471, IPC, in a case arising out of FIR No.408, dated 30.05.2015, registered at Police Station, City, Jind.
Learned counsel contends that all the offences for which the petitioner has been booked are triable by learned Judicial Magistrate First Class; after his arrest on 25.08.2015, the investigation was conducted and charge-sheet (challan) was presented and the case is fixed for consideration of charges; except the disclosure statement of the co-accused of the petitioner, which is not legally admissible evidence, there is no evidence to connect the petitioner with the offences for which he has been booked; and that Umesh, co-accused of the petitioner has already been ordered to be released on bail, vide order dated 30.11.2015, passed by this Court, in CRM-M-39698-2015. Learned counsel for the State has not controverted the factual aspects raised by learned counsel for the petitioner. However, he submits that the petitioner had attempted to induce the informant by handing the false and frivolous cheque worth `17,28,300/- (Rupees seventeen lacs twenty-eight thousand and three hundred only).
After hearing the learned counsel for the parties and going through the material available on record, the present petition is accepted. The petitioner, Ramesh Parjapati, son of Ram Subhag, resident of Maheshpur, Police Station, Rudrapur, District Deveria (U.P.), is ordered to be released on bail during pendency of the trial of the present case, subject to his furnishing bail bonds to the satisfaction of the trial Court.
