Through this petition under Section 439 Cr.P.C., petitionerMalkit Singh, has prayed for grant of regular bail in case FIR No. 0028 dated 06.03.2018 registered under Sections 420, 457, 468, 120-B IPC at Police Station Dhariwal, District Gurdaspur.

According to the prosecution, the petitioner along with his co-accused-Kanwaljit Kaur, cheated public at large i.e. around 35 persons for Rs.2.90 crores on the false pretext of providing them job in the Education Department.

Learned counsel inter alia contends that petitioner has falsely been implicated in the instant case. His name was not mentioned in the FIR. Kanwaljit Kaur, co-accused of the petitioner has already been granted regular bail by this Court vide order dated RISHU KATARIA 2018.09.21 17:26 I attest to the accuracy and integrity of this document
CRM-M-40457-2018 -210.08.2018 (Annexure P-2), passed in CRM-M-33226-2018. Thus, treating the case of the petitioner on the same parity, he may also be granted the concession of regular bail.

On the other hand, learned State counsel vehemently opposed the above submission of learned counsel for the petitioner. 5.
Considering overall facts and circumstances and treating the case of the petitioner on the same parity as that of his co-accused, the petition is allowed. Consequently, petitioner-Malkit Singh, is ordered to be released on bail pending trial, on his furnishing bail bonds and surety bonds to the satisfaction of Trial Court/Duty Magistrate concerned.
