The petitioner has approached this Court seeking grant of anticipatory bail in respect of a case registered vide Complaint Case No.NACT/65 dated 21.3.2017 titled Vinod Kumar Vs. Karanjit Kaur under Section 138 of Negotiable Instruments Act.

At the time of issuance of notice of motion on 7.7.2021, the following order was passed:

"Notice of motion for 27.10.2021.

It has been submitted by learned counsel for the petitioner that there were 6 identical complaints filed against the petitioner by the complainant and that while compromise has been effected in 3 of

( 2 ) such identical complaints, the negotiation for compromise in respect of the remaining 3 are going on and that there is likelihood that the same would be amicably resolved shortly. It has further been submitted that the petitioner has already been granted interim bail in respect of the other 5 complaints.

In view of the aforestated submission the petitioner is directed to appear before the learned trial Court within a period of 7 days from today. Upon her appearance before the trial Court, she shall be released on interim bail subject to her furnishing bail bonds and surety bonds to its satisfaction.

It is further clarified that the aforesaid interim directions are being issued solely for the purpose of enabling the petitioner to work out some amicable settlement and in case the same is not worked out, the aforestated interim directions may be withdrawn." 3.

Learned counsel for the petitioner has submitted that the matter already stands compromised and infact an application for withdrawal of complaint has already been filed by the complainant before the Trial Court. It has also been submitted that pursuant to interim directions, the petitioner has put in appearance before the Trial Court and is regularly appearing therein. 4.

Learned State counsel has submitted that since the petitioner has already compromised the matter, he does not seriously oppose the petition. 5.

In view of the aforestated position, wherein this Court finds that the matter basically arises out of complaint under Section 138 of Negotiable Instruments Act instituted against the petitioner and infact the petitioner has already compromised the matter, the petition is hereby accepted particularly keeping in view the fact that the petitioner is now stated to be appearing before the Trial Court. Consequently the interim directions issued by this Court vide order dated 7.7.2021 are hereby made absolute subject to the

( 3 ) condition that the petitioner shall appear regularly before the Trial Court and abide by any such condition as may be imposed by Trial Court for ensuring her regular presence.
