NARESH KUMAR SANGHI, J.(ORAL) Prayer in this petition, filed under Section 439, Cr.P.C., is for grant of regular bail to the petitioner, Gurpreet Singh son of Satnam Singh, resident of village Kainaur, Police Station Morinda, Tehsil Chamkaur Sahib, District Rupnagar, who has been booked for having committed the offences punishable under Sections 120-B, 420, 465, 468 and 471, IPC, in a case arising out of FIR No.116, dated 16.07.2015, registered at Police Station, Morinda, District Rupnagar.

CRM-M-39574-2015 -2which the petitioner has been booked are triable by learned Judicial Magistrate First Class; the petitioner is behind the bars from 01.10.2015; the case is still at the investigation stage and that during the course of investigation, the better sense has prevailed and informant-Kuldip Singh has sorted out his dispute and effected a compromise with the main accused-Om Parkash. Learned counsel for the State, on instructions from ASI Harmesh Kumar, Police Station, Morinda, has not controverted the facts that all the offences for which the petitioner was arrested on 01.10.2015 are triable by learned Judicial Magistrate First Class. He further admits that the petitioner is neither required nor involved in any other case.

In view of the totality of the facts and circumstances of the present case, the present petition is allowed. Petitioner Gurpreet Singh son of Satnam Singh, resident of village Kainaur, Police Station Morinda, Tehsil Chamkaur Sahib, District Rupnagar, is directed to be released on bail during the pendency of the trial of the present case subject to his furnishing bail bonds to the satisfaction of learned Area Judicial Magistrate/ trial Court.
