(ORAL) This Court was pleased to pass the following order on 24.10.2017 :- "This petition has been filed under Section 438 of the Code of Criminal Procedure for grant of anticipatory bail to the petitioner in the event of his arrest in case FIR No. 357 dated 5.8.2017 registered under Sections 365, 363, 366-A and 120-B IPC at Police Station Sadar Rohtak, District Rohtak. Learned counsel for the petitioner contends that the petitioner and the daughter of the complainant solemnised marriage on 1.9.2017 and both of them are residing together and, in fact, they had approached this Court seeking protection by way of filing Criminal Misc. M 36701 of 2017, in which notice of motion has been issued for 8.12.2017. Learned counsel would further contend that as per the medical report of the Radiologist, General Hospital, Sonepat, the age of the wife of the petitoner is stated to be between 19-20. Notice of motion for 15.2.2018.

Meanwhile, in the event of arrest, the petitioner be released on interim bail subject to her furnishing personal bonds and surety to the satisfaction of Arresting/Investigating Officer. However, the petitioner shall join the investigation as and when called upon to do so and shall abide by the conditions as provided under Section 438 (2) Cr.P.C "

Learned counsel for the petitioner submits that the petitioner has joined the investigation.

Learned counsel for the respondent-State, on instructions from the Investigating Officer confirms the factum of joining investigation by the petitioner.

Since the petitioner has joined the investigation, the petition is allowed and interim order dated 24.10.2017 is hereby made absolute subject to the condition that the petitioner will not tamper with evidence or hamper the investigation; will not leave India without permission of the Court and will comply with the conditions contained in Section 438(2) Cr.P.C. 31.08.2018 (JAISHREE THAKUR) Satyawan JUDGE Whether speaking/reasoned Yes.
