This matter is being taken up for hearing through video conferencing due to the outbreak of the pandemic, COVID-19.

It is submitted that the petitioner has been falsely implicated in the present case due to factionalism in the village. The petitioner and the complainant are neighbours. Bare perusal of the FIR, it is submitted, reveals the falsity of the same. It is opposed to all probabilities that the petitioner would enter the complainant's house at midnight knowing fully well that the complainant's husband and children are present in the house. Moreover, it is contended that an unexplained delay of about a week in the registration of the FIR creates a further dent in the present case. The incident is alleged to have taken place at midnight of 28.06.2020, whereas the FIR is registered on 04.07.2020. The petitioner, it is submitted, is not involved in any other criminal matter.
