This criminal miscellaneous petition has been filed by petitioner under Section 438 Cr.P.C. praying for issuance of appropriate directions to the trial Court/arresting officer to release the petitioner on bail forthwith in the event of her arrest in case FIR No.508 dated 10.8.2015 registered for the offences under Sections 419, 420, 467, 468, 471 and 120B IPC at Police Station City Fatehabad, District Fatehabad. I have heard learned counsel for the petitioner and have gone through the record.
From the record, I find that FIR in the present case has been registered on the basis of complaint against the present petitioner along with other persons. The main allegation is that the land of the complainant party i.e. Kadiya, Ram Pyari and Hardo etc. had been sold by impersonating other ladies. The present petitioner Kamla Bai is stated to be the beneficiary as HARPAL SINGH PARMAR 2015.11.28 17:01 I attest to the accuracy and authenticity of this document Chandigarh
Cr. Misc. No.M-39637 of 2015 [2] sale deed had been executed in her favour. It is also in the FIR that all the accused knew it very well that they were getting the ladies impersonated. Kamla Bai and Parhlad Singh accused before getting this deed registered in the name of Kamla Bai, got it scribed from Jagdish Tada, Advocate, Deed Writer.
Keeping in view the nature and gravity of the offences and the fact that the petitioner is named in the FIR, she is the beneficiary and she is required for custodial interrogation, I do not find it a fit case where the petitioner is entitled to the benefit of anticipatory bail. Therefore, finding no merit in this petition, the same is dismissed.
