SUDIP AHLUWALIA, J. (ORAL) Perused the Reply filed on behalf of the Respondent/State by way of the Deputy Superintendent of Police, Yamuna Nagar-IV. 2.
It transpires that once the Petitioners, along with other accused persons, in the present case, were interrogated in FIR No.189 dated 24th March, 2020 of Police Station Thanesar, and it was confessed by the accused persons concerned themselves that they had tried to commit theft from the ATM Machine of Bank of Baroda at Jagadhari, as also to steal the ATM Machine of PNB Chhappar. Thereafter, the accused persons were released on bail in the case in which they had been originally arrested i.e. FIR No.78 dated 29th March, 2020.

It is, therefore, clear that the only available material to link the Petitioners with the alleged occurrence in this case pertaining to FIR No.428 DEEPAK KUMAR 2020.07.29 18:04 I attest to the accuracy and integrity of this document
CRM-M No.19867 of 2020 -2dated 28th March, 2020 is their own Confessional Statements made during interrogation in some other case being investigated by the Police. 4.
On 22nd July, 2020, a Co-ordinate Bench of this Court had granted them interim protection by way of Anticipatory Bail. 5.
As such, in view of the absence of any cogent material linking the Petitioners to the alleged occurrence, the interim bail granted to them earlier on 22nd July, 2020, is hereby confirmed. 6.
Disposed off.
