The petitioner is alleged to have got allotted a plot from HUDA in Bahadurgarh on 28.9.2001 and another plot on 28.1.2002 in Bhiwani. The allegation against the petitioner is that on the basis of false information he has obtained the benefit and that he further transferred the second plot to one of his close relations.

The petitioner pursuant to the interim order passed by this court has already joined the investigation as per the instructions of SI Ramesh Kumar, imparted to the learned State Counsel. The controversy regarding such allottees is stated to be pending in a bunch of cases, attached with CRM M 26292 of 2013 (Dharam Singh Yadav vs. State of Haryana and ors). Without expression of any opinion if there has been any violation of the instructions, it is always open to the HUDA authorities to take necessary steps, in accordance with law. However, it does not appear to be a case of custodial interrogation. Accordingly, the petition is allowed and it is ordered that in case of arrest of the petitioner, he will be released on bail to the satisfaction of the arresting officer subject to the condition that he will join the investigation as and when required by the police and will not tamper with evidence or hamper the investigation.
