Instant petition has been filed under Section 482 Cr.PC for quashing of the order dated 13.04.2023 (Annexure P-5) passed by Addl. Sessions Judge, Patiala in complaint case No.3 date 15.02.2014 under Section 302, 34, 279 and 304-A IPC registered at P.S. Ghagga, District Patiala vide which non-bailable warrants have been issued against the petitioners. 2.

Learned counsel for the petitioners submits that the petitioners were granted anticipatory bail by this Court vide orders dated 14.08.2018 and 24.09.2019 respectively and thereafter, they were regularly appearing before the Court concerned. Learned counsel further submits that the petitioners could not appear before the Court below only on one date due to an inadvertent mistake as they had noted a wrong date. Learned counsel still further submits that the petitioners are ready to appear and surrender and thereafter join proceedings before the trial Court.

On the asking of Court, Mr. Amit Rana, Sr. DAG, Punjab accepts notice on behalf of the respondent-State.

In view of the submissions made above, the petition is disposed of with directions to the petitioner to appear and surrender before the trial Court on or before 07.05.2023 and move appropriate application for grant of bail. Till then no coercive steps be taken against the petitioners. The trial Court on such application being moved shall decide it expeditiously in accordance with law. It is, however, made clear that in case the petitioners fail to appear and surrender before the Court below within the above stipulated time period, then this order shall be of no avail to them.
