CRM-M-39698-2015 Prayer in this petition, filed under Section 439, Cr.P.C., is for grant of regular bail to the petitioner, Umesh son of Prahlad, resident of village Maheshpur, District Deveria (UP), who has

-2been booked for having committed the offences punishable under Sections 420, 467, 468 and 471, IPC, in a case arising out of FIR No.408, dated 30.05.2015, registered at Police Station, City, Jind, District Jind.

Learned counsel contends that all the offences for which the petitioner has been booked are triable by learned Judicial Magistrate First Class; after his arrest on 30.05.2015, the investigation was conducted and charge-sheet (challan) was presented and the case is fixed for consideration of charges. He further points out that the petitioner is neither required nor involved in any other case.

Learned counsel for the State has not controverted the factual aspects raised by learned counsel for the petitioner. However, he submits that the petitioner had attempted to induce the informant by handing the false and frivolous cheque worth `17,28,300/- (Rupees seventeen lacs twenty-eight thousand and three hundred only).

After hearing the learned counsel for the parties and going through the material available on record,the present petition is accepted. Petitioner-Umesh son of Prahlad, resident of village Maheshpur, District Deveria (UP), is ordered to be

-3released on bail during pendency of the trial of the present case subject to his furnishing bail bonds to the satisfaction of the trial Court.
