This matter is being taken up for hearing through video conferencing due to the outbreak of pandemic, COVID-19.

This is petitioner's second application seeking anticipatory bail in FIR No. 26 dated 16.04.2021 under Sections 406, 420 IPC and Section 13 of Punjab Travel Professional (Regulation) Act, 2014 registered at Police Station Aur, District Shaheed Bhagat Singh Nagar, Punjab.

Petitioner's first application for bail was dismissed as withdrawn on 28.05.2021. However, present petition, it is submitted, was filed as the petitioner sought to amicably settle the entire dispute with the complainant. Learned counsel for the petitioner and complainant/respondent No. 2 submit that the matter has been amicably resolved between the parties. CRM-M29589-2021 has been filed for quashing of above said FIR. Statements of the parties in this respect, it is stated have been duly recorded before the concerned Illaqa Magistrate on 09.08.2021 and CRM-M-29589-2021 is now listed for hearing on 02.02.2022.

CRM-M-24732-2021 -2Learned counsel for the State, on instructions from ASI Vijay Kumar, verifies the factum of settlement between the parties and recording of their statements in this respect as well as pendency of CRM-M-29589-2021. It is further verified that petitioner is not involved in any other criminal case. Keeping in view the facts and circumstances as above especially the settlement arrived at between the parties, this petition is allowed. The petitioner shall join investigation as and when required by the investigating agency. In the event of his arrest, petitioner be released on bail to the satisfaction of Investigating Officer. Petitioner shall comply with the conditions stipulated in Section 438(2) Cr.P.C.
