CWP No. 11319 of 2021 -2Main case. Learned counsel appearing for respondent no.5 has pointed out that the present writ petition has been filed by petitioner Desh Raj aggrieved by order dated 10.2.2021 Annexure P-3, passed by respondent no.1 - Deputy Commissioner, Kurukshetra-cum-District Magistrate-cum-Appellate Authority under Maintenance and Welfare of Senior Citizen Act, vide which appeal filed by respondent No.5 Satbir Kaur against order dated 15.9.2020 Annexure P-2, passed by respondent no.

2 - Sub Divisional Officer (C) Pehowa, District Kurukshetra, exercising power of Presiding Officer under the Maintenance and Welfare of Senior Citizen Act, was accepted, had been set aside and the case had been remanded to Sub-Divisional Magistrate, Pehowa, calling for its comments as per the guidelines given in the Maintenance and Welfare of Parents and Senior Citizens Act, 2007, certified copy of which has been placed on record. Now the Additional District Magistrate, Kurukshetra, has dismissed the application under Section 23 of the Act, filed by Desh Raj, vide order dated 2.11.2021 Therefore, the writ petition has become infructuous. Ms. Rinki Gupta, Advocate appearing for petitioner - Desh Raj has admitted this fact.
