(Oral) Both the counsel appearing on behalf of the parties are ad idem that compromise has been effected between the parties during the mediation proceedings which were carried out in the Mediation Center of this Court and that the concerned settlement deed (Annexure A-1) is dated 2.11.2021, which is bearing signatures of both the parties and that in compliance of said settlement deed, the entire settled amount has been paid by the petitioners to respondent No.2/complainant-Rajiv Jain son of Surinder Kumar Jain, proprietor M/s Jain Yarns, Ludhiana and that now nothing remains due against the petitioners.

( 2 ) CRM-M-24532-2021 The counsel appearing on behalf of respondent No.2/complainant-Rajiv Jain has today given undertaking that if any petition regarding quashing of FIR No.210 dated 15.8.2019 registered at Police Station Moti Nagar, Police Commissionerate Ludhiana under Sections 420, 406, 182, 193 and 120-B IPC is filed by the petitioners on the basis of the aforesaid compromise, then respondent No.2 will be having no objection if the said FIR is ordered to be quashed by the Court of competent jurisdiction. The counsel for the petitioners made prayer that in view of the aforesaid undertaking given by respondent No.2/complainant-Rajiv Jain, he be allowed to withdraw the present petition with liberty to file petition seeking quashing of aforesaid FIR on the basis of settlement deed (Annexure A-1) dated 2.11.2021 with further liberty to revive the present petition if in future any cause of action survives with further prayer that the presence of the petitioners before the learned trial Court be exempted for a period of next 3 months.

Accordingly, the present petition stands dismissed as withdrawn with aforesaid liberty and the presence of the petitioners before the learned trial Court is exempted for a period of next 2 months only from today. ( KARAMJIT SINGH) 07.02.2023 JUDGE Gaurav Sorot Whether reasoned / speaking?
