Counsel for the petitioner has urged that the petitioner himself is a victim having been duped with a false promise to send him abroad. With the assistance of ASI Judge Singh, I have gone through the police record, which indicates that statements of three complainants stand recorded to the effect that the petitioner along with other co-accused had received money from them. Paramjit Singh another accused is evading arrest.
I have considered the contention of counsel for the petitioner that the petitioner having been falsely implicated in the case and he himself is a victim. I do not find sufficient ground, at this stage, to accept the said defence plea of the petitioner.
In view of the nature of the allegations against the petitioner; co-accused of the petitioner having not been arrested; the investigation being still in progress, no extra ordinary exceptional circumstances exist to grant the concession of pre-arrest bail to the petitioner. Dismissed, without prejudice to the right of the petitioner to seek the concession of regular bail, as per law.
