(Oral) The allegations against petitioner Gurdit Singh @ Baba @ Gagandeep Singh in this regular bail application under section 439 Cr.P.C. are that on 4.11.2016 he along with eight more persons had assaulted Jatin Kumar at his shop and it is alleged that while running away they have taken cash lying in the shop.

The contentions of counsel for the petitioner are that it is personal fight between two groups and that none of the ingredients attracting sections 392 and 394 IPC are made out and it is pure and pure personal fight and that the petitioner is in custody since 22.11.2016. Learned State counsel with all fairness has conceded that apparently there was a fight between two groups and thus attraction of sections 392 and 394 IPC is a debatable issue. Criminal Misc.
