Jaskaran Singh has preferred this petition under Section 439 Cr.P.C. seeking bail in case FIR No.163 dated November 6, 2013 under Sections 306, 406, 212, 148, 149 IPC, Police Station, City Samana, District Patiala, during pendency of trial. 2.
A perusal of record reveals that present FIR has been registered on the basis of statement of Sukhwinder Singh @ Sukh who has unfolded that his niece Kuldeep Kaur, her husband Kanwaljit Singh and their son Bikram Singh committed suicide on November 6, 2013 by hanging themselves with a tree near Rice Sheller as Kanwaljit Singh AVIN KUMAR 2015.03.25 14:45 I attest to the accuracy and authenticity of this document High Court of Punjab & Haryana at Chandigarh
Criminal Misc. No.M-39859 of 2014 [2] was having a dispute with Harjit Singh in respect of Rice Sheller. Since names of petitioner as well as his wife Baljit Kaur, Harjit Singh and Gurdeep Kaur appeared in suicide note, they were arrested in this case. 3.
Here, it would be pertinent to mention that Kuldip Kaur has already been allowed bail by this Court vide order dated September 9, 2014 whereas Baljit Kaur and Gurdeep Kaur wife of Harjit Singh have been granted concession of bail by trial court vide orders dated April 25, 2014 and April 17, 2014, respectively. Case of petitioner is not on different footings than that of persons who have already been granted concession of bail. Petitioner being similarly situated also deserves concession of bail.

Accordingly, petition is allowed. Petitioner is ordered to be released on bail subject to his furnishing personal/surety bonds to the satisfaction of trial court.
