This is a petition filed under Section 438 Cr.P.C. seeking pre-arrest bail in a case registered against the petitioners vide FIR No. 548 dated 15.09.2014 under Section 306 IPC at Police Station Central Faridabad, district Faridabad.

At the outset, learned State counsel submits that a cancellation report has been prepared and likely to be submitted before the competent court shortly.

At this stage, learned counsel appearing for respondent no. 2 prays that he may be given liberty to file a protest petition before the concerned court.

As no cause of action survives in this petition, same is dismissed as having been rendered infructuous. Respondent no. 2 shall, however, be at liberty to avail the remedy available to him under the law before the court where final report is filed by the investigating agency.
